Was the newspaper curricular or extra-curricular?
Virtually all high school newspapers are curricular. But even so, under the "Panda test" soon to be adopted by the Supreme Court in Hosty v. Carter, they can't engage in viewpoint discrimination.
Is an factual article about birth control a viewpoint? Aren't most of the cases in this feild about editorial or opinion-based articles?
This is straight-up Hazlewood, innit? The school can censor to protect kids from hearing things their little sensitive ears can't take.
